Job Description:
The City of Oakland’s Real Estate Division is seeking an experienced Right of Way Agent for an on-call, as needed position. The Right of Way Agent will provide technical and administrative support for City of Oakland transportation projects, ensuring compliance with all applicable Federal, State, and local laws, including the Uniform Relocation Assistance and Real Property Acquisition Act (1970) as amended. This role involves interpreting complex real property-related documents, assisting with acquisitions, and supporting public projects requiring real property rights. This position will be remote with occasional in-person meetings or site visits within the City of Oakland. This is an at-will position, exempt from the provisions of the City of Oakland Civil Service Rules, per Charter Section 902.
The position will report to the Supervising Real Estate Agent within the City’s Real Estate Division and will provide right of way services to the City’s Department of Transportation (OakDOT). OakDOT’s mission is to envision, plan, build, operate and maintain a transportation system for the City of Oakland and assure safe, equitable, and sustainable access and mobility for residents, businesses and visitors. Job Requirements:
Key Responsibilities:
Ensure compliance with laws and regulations governing property acquisition and relocation.
Interpret maps, engineering plans, title reports, and legal documents related to property rights and eminent domain.
Assist in drafting appraisal reports, contracts, deeds, and other documents for property acquisition and rights-of-way.
Prepare specialized property documents such as Permits to Enter and Construct, Rights of Entry, and Temporary License Agreements.
Support the land disposal process for excess properties, including valuation of contributory property values.
Assist in determining construction and improvement costs for public projects.
Identify and interpret public rights-of-way, encroachments, and access issues.
Analyze rights of public and private utilities within City franchise areas and easements.
Oversee and review work performed by external right-of-way consultants.
Communicate and negotiate directly with property owners on smaller projects.
The primary work location will be remote; however the position may require project site visits from time-to-time. Reasonable proximity to the City of Oakland is required.
Qualifications:
Knowledge of Federal, State, and local property acquisition laws and regulations.
Ability to interpret maps, engineering plans, and legal documents.
Strong understanding of appraisal processes and eminent domain procedures.
Familiarity with environmental compliance and utility rights.
Excellent communication and negotiation skills.
International Right of Way Association certification required (Right of Way Agent, Right of Way Professional or Senior Right of Way Professional). Senior Right of Way Professional (SR/WA) is desirable.
Individuals who are appointed to this position will be required to maintain a valid California Driver's License throughout the tenure of employment.
This position will require a background check.
